1. Agreement
These Terms of Use ("Terms") govern your use of the TrekLedger mobile application ("App"), a Mandooist app operated by Jason Reeve ("we", "us", "our"), based in Australia.
By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
2. The service
TrekLedger is a trekking journal. It keeps a page for each day of a trip with your notes, photos, voice notes, imported GPX tracks, daily steps and marks stamped with a GPS location, all stored on your device. The App is free.
3. Eligibility
You must be at least 13 years old (or 16 in the EU) to use the App.
4. Safety outdoors
TrekLedger is a journal, not a navigation or safety device. Do not rely on it to find your way, to find water, food or shelter, or to avoid a hazard. GPS positions can be wrong by tens of metres or more, maps can be incomplete, and conditions on the ground change. Carry proper maps, navigation and emergency equipment, check local conditions and warnings, and tell someone your plans.
Marks you record, such as water sources, campsites or hazards, are your own notes. If you share them, for example as a GPX file, others should treat them as a guide only, and so should you with marks shared by anyone else.
5. Your content
Your journal, photos and recordings remain yours. They are stored on your device, and this version of the App does not back them up: you are responsible for keeping your own copy with Export all data. You are responsible for what you choose to share, and for having the right to share it.
6. Acceptable use
You agree not to reverse engineer or tamper with the App, or use it for any unlawful purpose.
7. Intellectual property
The App, its design and our branding are owned by us or our licensors. Map data is from OpenStreetMap contributors via OpenFreeMap, under their own licences.
8. Disclaimers
The App is provided "as is" without warranties of any kind. Location accuracy, step counts and photo details depend on your device, its settings and other apps.
9. Limitation of liability
To the maximum extent permitted by Australian law and the law where you live, we are not liable for injury, loss of data, or indirect, incidental or consequential damages arising from your use of the App. Our total liability for any claim related to the App is limited to the amount you paid us in the twelve months before the claim, or AUD $50 if you paid nothing.
Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.
10. Changes
We may update these Terms and will change the "Last updated" date above. Continued use after changes means you accept them.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non exclusive jurisdiction of the courts of New South Wales.
